Yip: An addendum to Ray's post on CA knife carry laws: It is my understanding that intent also matters. Thus, if you are being questioned by an LEO who asks you what the knife is for and you answer "Self-defense." you are declaring an intent of using the knife as a weapon. That means as long as > > the knife folds, no matter how large the blade is, it is legal. > > ... [snip] ... > > That, too, is my understanding. When lengths are specified in the CA PC > it is wrt legal def of a switchblade (>2.5 in., I believe). But CA PC does > specify it is illegal to carry blades, I think over a certain length, in > public schools/colleges/etc. Some quick research at the California State Legislature site: http://www.leginfo.ca.gov/cgi-bin/calawquery?codesection=pen&codebody=knife turned up the following. From 12020 the following appear to be ILLEGAL: - --> Carrying a *concealed* fixed blade of any size - --> Carrying a *concealed* locking folding blade of any size - --> Carrying a *concealed* nonlocking folding blade of any size while open - --> Any "belt-buckle" blade of length >= 2.5" (see section 13) - --> Any "hidden" blades (eg, in a cane, faux lipstick container, etc) - --> Any shuriken - --> Any blackjack, sap, etc. From 653k the following appear to be ILLEGAL: - --> Carrying an automatic ("switchblade") knife of length >= 2" From 626.10 the following appear to be ILLEGAL: - --> Carrying a fixed blade or folding locking blade of length >= 2.5" on the property of *any* school, public or private, without official endorsement (ie, for the purpose of instruction, work, etc) From 171b.3 the following appear to be ILLEGAL: - --> Carrying *any* blade of length >= 4" into a state or local building So... it appears that with regard to *concealed* blades you can carry without a problem: * Automatic (switchblade) knives of length < 2" * Folding, nonlocking blades of any length while folded * Belt buckle knives of length < 2.5" with the only exceptions being state and local buildings (4" limit) and federal buildings (not sure of restrictions). With regard to: "Knives carried in sheaths which are worn openly suspended from the waist of the wearer" (12020.24.d) it appears that you can carry just about anything so long as you observe the restrictions for local, state, federal, and school properties and don't go threatening anyone. Note that this is with regard to California state penal code only. Regulations vary from city to city (notably parts of LA and SF) so you should ask your local LEO if there's anything particular to your area. In addition, federal laws most likely apply -- you should be aware of them before entering federal property. In addition, when I say "illegal", I mean that violation of such statutes will likely subject you to prosecution for a misdemeanor or in certain cases a felony. BTW: I'm an engineer, not a lawyer. So before planning your defense on my 15 minutes of research you should consult Someone Who Actually Knows What They're Talking About. YMMV, my opinions are my own and not necessarily those of my employer, use common sense, etc... I have been following a series of posts by Phil Dunlop of the Kachin Bando system. This is a separate tribe from Dr. Maung Gyi. He has been covering some drills from the clinch, and grappling techniques from Burmese wrestling. They are rather well designed, articulate posts. He gave a FREE seminar, and half of it was taped, and available for cost. He plans another FREE seminar,...this will be taped and available for cost at well. There is a review of the tape on PLANETNHB(dont have the url,...sorry). TRS, the "National Enquirer" of tape promotion companies has approached him for a tape series, but he is aware of their ads, ....and said no. He says that he does not come off well on camera, and feels uncomfortable being the center of attention. Do any New Jersey E-Digest readers know about this guy?? I am kind of intrigued. He described sealing off the seams of the body to create control and submissions, and his variation of the guard, mount, and knee(shin) on stomach. Please read the posts, and share your thoughts... For knife length see the last issue or two of this digest. Ray Terry Yes, us Californians got hit real bad on all sticks and nunchakus....got stopped one night after the law went into effect. If I hadn't taught the police officers' teachers at the LAPD academy I'd have ended up in the pokey.....but although I taught Bruce Lee the small (incomplete) form he did in the film, I had to give up teaching nunchaku because the "legal" ones just don't have the right weight and handling capabilities of the real thing. For a while I taught my students to roll up newspaper sections VERY tightly.....they made excellent sticks and one time one of my students put one through the side of a truck. Carry it under your arm. If a cop stops you quickly break the tapes that are holding it so tightly and let it fall loose. b ------------------------------ From: CoryHanosh@astec.com Date: Wed, 15 Sep 1999 12:30:00 -0700 Subject: RE: Inayan_Eskrima/FMA-Digest V6 #391 All, I will be traveling to the UK shortly, on business, and I might have some free time to discuss/promote the Inayan System of Eskrima.
