Even in Colorado with it's infamous "Make my day law" you can't just shoot someone for being in your house. You WILL go down either criminally or civilly for answering any of these questions wrong. Folks, would you expect a lawyer to be able to step into the sparring ring with you and win? No...it's not his turf, it's yours. He doesn't have any training or experience there. He's going to lose miserably. Conversely, as martial artists we really need to extract our heads from certain orifices and understand that without SPECIFIC training about the legal application of force if you ever have to use your martial arts in self-defense you WILL get reamed in court! You are stepping into the lawyer's sparring ring and - without understanding of the legal limits and applications of force - odds are you have handed him the very rope he's going to hang you with. Bottomline folks, while most people will never use their marital art training in self-defense, we are the possessors of dangerous tools. You can't carry a gun in the states without basic safety training, certification and a passing acquaintance of when you can and can't use it. Even then, they highly recommend you go out and do further research into the legal applications of the tool. Why? Because they know how much trouble you can into using it. This is the real world folks. Let me ask you: what would you think of someone who insisted on carrying a gun without having checked into the legal issues and limitations surrounding it's use? Well, guess what, the Marital Arts are the same thing, except that your body is the loaded gun. And NOBODY can predict when and if you will end up having to use it. Unless you live out in Podunk Iowa where odds of running into a violent a**hole are slim to none, you better look into the legal limits and applications of that skill you possess. Even if you just train as a hobby, that skill is there with you. If you live in the city, sooner or later you WILL run into someone who is a howling barking moron. Now most people have the brains to back off in such a situation, but way too many hobbyist marital artists won't retreat as fast as the average bear. And that is exactly what will put them into a situation where they might end up using their art. And guess what, you just stepped into the lawyers ring. DON'T take your guru's word for it, go out and learn it yourself!!!! There is an old Bill Mauldin "Willie and Joe" cartoon from WWII. The two grizzled combat vets are sitting there looking at a new replacement, who is spit and polish and is swaggering by with a truculent sneer. "Willie looks over and says "You can tell he ain't been in combat, he WANTS to fight." Let me say, right now, don't give me the macho bulls**t of "I'd rather be judged by twelve than carried by six" that is so common among keyboard warriors. Not only does that statement loudly declare your lack of experience with actual physical conflict, but it loudly declares your ignorance of the repercussions of violence in the legal, psychological and sociological arenas that surround violence. What's worse is that some newbie will take your words as gospel and adopt that same suicidal mindset. Which is another reason why I strongly advocate not accepting your guru's word on this issue. He might have fallen into that same trap of not looking it up because he assumes he will be "right" in his use of force. I have seen way too much BS pedaled as "self-defense" by MA instructors that would put the student in prison or sued into poverty. Scary thing is most students never question it. In closing let me point something out. As martial artists you have the ability to cause damage to another human being. If you don't go out and take a class, research or in other ways learn to indemnify yourself from the legal repercussion of using your skills you are not only putting yourself at risk, but you are putting your family's financial well being at risk. You might get questioned by LEO if stopped, but it shouldn't be a big deal. In some areas, folders significantly bigger are also acceptable. Expandable batons are an explicit no-no in many areas, and though I'm told it isn't officially so in my neck of the woods, LEO's still have a bit of attitude about them. Why? A knife is a tool that can be used as a weapon. An expandable baton is a weapon, period. Knives that are essentially only weapons (daggers) are usually also explicit no-nos.
