Reply-To: eskrima@martialartsresource.net When the officer makes contact and asks the person if he/she can speak with them, the person tells the officer to "screw off" or starts mouthing off at the officer. Other people are around and this usually causes the officer some level of embarrassment. But the officer has to remember, that with a citizen/voluntary contact, none of the 3 elements exist that activate our authority, so there is nothing the officer can do in this situation except swallow their pride. In New York if a person becomes a real s*%$t head you in a public place you have the option of charging violation disorderly conduct. You may have to explain the circumstance to your supervisor, but its still a good arrest if its within the following parameters. NYS PL 240.20 Disorderly conduct. A person is guilty of disorderly conduct when, with intent to cause public inconvenience, annoyance or alarm, or recklessly creating a risk thereof: 1. He engages in fighting or in violent, tumultuous or threatening behavior; or 2. He makes unreasonable noise; or 3. In a public place, he uses abusive or obscene language, or makes an obscene gesture; or 4. Without lawful authority, he disturbs any lawful assembly or meeting of persons; or 5. He obstructs vehicular or pedestrian traffic; or 6. He congregates with other persons in a public place and refuses to comply with a lawful order of the police to disperse; or 7. He creates a hazardous or physically offensive condition by any act which serves no legitimate purpose. Disorderly conduct is a violation. This is one of those laws with an abuse potential, but it can be a great tool to put some smart ass who thinks he can get over on you in a different frame of mind. You just have to use it like a scalpel and not a sledge hammer. However, "little" Addy can play with most of us and probably take some too! I only met Sifu Simonet once a few years ago at one of Datu Worden's Water & Steel camps. Often, the seminar or tape star has a training partner. Usually, it's a male. In the Simonet case, it's his business partner Addy Hernandez. In a two person demonstration team, there are four combinations of sex. I'll make come comments based on my participation in two of Joe Simonet's hour-long sessions at the Kenpo Gathering of the Eagles 2 in July, 2001. Simonet is technically proficient and a dynamic presenter. His physical presence and dramatic "change of angle" speaking style distinguish him. In a few examples, he threw Addy around. We were all amazed to watch her bounce off the floor without a complaint. (The long flying hair was great, too.) Clearly, this level of man-handling is easily within her abilities. She gained a lot of respect from my friends and me . In a few examples, she manipulated Simonet. Watching a woman of a relatively slight build (well, she is quite buff) manipulate a large fellow such as Simonet was great. Most of the time, Addy was an "equal" partner in the team's demonstration of hand-to-hand and stick-to-stick drills.
