If that is true, I am surprised that Cantwell did not get arrested for aggravated assault and interfering with a police officer. Also the kid's parents could financially ruin this guy. People do stupid things when they think they are covered by self defense. In most states just defending your property is not enough to use deadly force. I am sure some scum bag lawyer is talking to the kids parents about pain and suffering, being scarred for life, ... where big bad Cantwell assaulted with malice poor little Johnny even after it was determined that Johnny was unarmed and had no weapon. In civil court the plaintiff only has to show that there is ONLY a 51% probability that the defendant is the cause of the resulting lose to win the case. (NO shadow of doubt, 49% loses $$$$$$$) >I find the whole incident inspirational. Before you get to inspired, if you anticipate ever being in a situation where you use deadly force or something close to it, know what you legally can do. Know the different between criminal and civil court. Understand police forensics, so not to make a liar out of yourself. Have the basic story line elements in your head that shows your actions are reasonable/justified under the law, and be ready to incorporate them into any real story you may have to tell. Winning in court can be harder than winning on the street. Sometimes bad guys win and good guys loose. Protect yourself with knowledge and forethought first. Then you can be inspired. Sorry, I am not trying to be an asshole, just throwing in 2 cents worth. ~~~~~~~~~~~~~~~~~~~~~~~ No offense taken. Perhaps I should have clarified my statement. We have had incidents around here of homeowners being murdered because they did not take a stance against those breaking into their homes. This gentleman decided to stand firm and defend himself and his property. I appreciated the show of spine. You are right about the legalities, and I am sure the little peckerhead's court-appointed attorney will work that angle mercilessly. The common rule-of-thumb around here (and I have actually heard this several times from the most unexpected sources) is that if you catch a perp invading your home you have to keep him there until the cops show-up -- otherwise *you* will be charged for assault. Liberal laws [ugh!]. This guy must have been aware of it, having forced the kid to sit tight until the LEO's arrived. ~~~~~~~~~~~~~~~~~~~~~~~ MarkLugtu@aol.com wrote: its a good thing that the home owner wasn't charged. here in england a farmer shot a person trying to break in to his house and was charge and convicted. i'm not sure if the burgler died but the police said he placed the law into his own hands. im not sure i agree with the police this time but i guess there are really differences in how you interpret law in every country. ~~~~~~~~~~~~~~~~~~~~~~~ Sadly, here in Iowa, too. Some years ago a farmer was charged when he booby-trapped one of his homes (he owned a couple of properties, but only lived in the house on one of them) with a shotgun aimed at the front door, having been the victim of vandals on several occasions. Sure enough, some vagrant broke in and got wounded. His court-appointed attorney took the low road and got the "victim" off the hook and the farmer jailed. I'm not supporting vigilantism here, by any means. I just wanted to applaud Cantwell for standing firm to protect himself and his property, and kept a cool enough head to keep the perp in place until the cavalry arrived. That he probably used excessive force I won't argue with. I'd like to think I wouldn't panic in a similar situation, but one never knows until pushed. There is the suggestion that Martin laid in wait for the "next" lot of burglars, and shot at them to scare them. Unfortunatley, one of the burglars was a small sixteen year old boy, and instead of getting shot in the legs, he was wounded in the lower back. He climbed over a fence in the garden, fainted and bled to death. Martin was charged, and has just failed in an attempt to get early release. The boys adult accomplice was wounded in the legs, but still managed to get away - leaving the boy to his fate. The boys extended family are said to have put a price on the accomplices head.
