My memory of the post that started this thread was that someone said that they had someone with HIV who wished to train at their school. My comment is responsive to this person. I'm not sure why you would take it generally, but there it is. As for the matter you bring up, that of someone who knowingly has HIV AND knowingly puts others at risk, it is a despicable thing. In a sense, it is a form of murder/manslaughter. I would have no problem with criminal consequences for this. Which brings up the question of when an HIV person should speak up. Given the tremendous fear and stigma attached to the disease and the assumptions made concerning method of transmission, not to mention the range of attitude shifts towards someone known to have a probably terminal disease, it is entirely understandable that an HIV person not want this getting out. I would submit that many/most people don't keep "secrets" and knowing this that the HIV person is continuously confronted with dilemmas. Furthermore, in a horrendous expansion of the Orwellian state, thanks to regs began by Clinton and approved by Bush, know that the federal government has everyone's medical records. If Clinton's record of the politics of personal destruction combined with access to allegedly "secret" government files are any indication (e.g. his accessing IRS records and FBI background check records) political enemies will have access to these records. Anyone with any condition that they don't want known will be subject to political blackmail. Privacy shrinks as inexorably as the number of animal species on the planet. So folks, question presented: When should someone with HIV speak up? And, what consequences for those who violate confidentiality? I may be blowing it, but again I submit that the person who shared his condition with his prospective martial arts instructor showed integrity. I also submit that we will encourage disclosure the more we do not get irrational in our responses. As to what is rational and irrational, my "no claim to special insight" still applies :-). And again I submit that it is PC fascism for the state to impose responses upon people. For example, the idea that a martial arts school owner should find himself having to choose between what he believes to be right and going broke in a lawsuit due to the impositions of "anti-discrimination" laws and regulations of the PC fascists is yet another sign of this country becoming less free than it was. The points were the rear outer edges of the helmet and the tip of the thumb and the ridge of the hand on the hockey glove. Does anybody have a remedy for this situation? The fact that they have told you would mean they are trying to be responsible. That said, as a school owner I would never knowingly take on an HIV positive student into a group class. As small of a possibility as transmission is, it is still possible. I'd much rather deal with legal problems than to know I could have prevented serious health problems.
