Tang Soo!
Ok, I did some research, since I had some free time (I am a paralegal in a
law office, can you imagine that I need to find some free time to do legal
research??!!) Anyway, I found a case which is quite recent. It is about a man
who bit another man's finger off (practically), and the case made it to
appellate court. They basically decided that a part of a person's body cannot
constitute a dangerous weapon and the case cites martial artists and boxers
as examples of why this is their reasoning. It makes sense-you would have to
make each person liable on a sliding scale based on their rank if you could
say that a person is using a deadly weapon when they fight with their hands
having a boxing title or ranking in MA. They go on to say that a deadly
weapon can be the sidewalk if you bash someones head on it, but not a part of
your own body.
I hope this link appears as a hyper link so those of you interested can look
at it, but if it does not, please e-mail me, and I will send you the case.
I just think that it is comforting to know that you can actually use the
knowlege that you have, without fear of being treated by the law the same way
as if you had a gun. You still have to face the regular consequences of
assault and battery, but nothing more merely because you study MA.
Any Comments?? Any atty's on the digest want to comment??

advice from those of you who have recently made the
decision? John?
Greg Giddins
Yeah! If you are thinking about opening a martial arts school...............get a
CAT scan done. If you still want to do it after that.....then stick to a sole
proprietorship. Less hassells and headaches, easier book keeping, you can file the
business on your personal income taxes....and if you are successful...you don't
have to share with the others in the sand box (hehehe). 'Course...if'n ya dunt
succeed....you're screwed!

Mr. Giddins,
You didn't describe what your business was, so I doubt anyone can
begin to imagine what might be the best option for you. Take a look
at http://www.inreach.com/sbdc/book/legal.html for basic descriptions
of each type of company. There are lots of web sites with info on
the pros and cons of each structure.
Good luck!

Greg, that is the kind of advice that lawyers charge big money for giving!
However, the Small Business Development Center at my local state university
campus had some wonderful brochures and resource papers when I was trying to
decide the business form for my own small business (a private practice in
mediation and consulting that is definitely not a martial arts school ).
Look for an SBDC at a university near you; they are all over the country and
provide free consulting services for small businesses and newly developing
businesses. Also look online at the US SBA (Small Business Administration)
website for information on this topic. The attorney teaching that particular
section on the class I took on starting a small business was very
definitely in
favor of LLC for single proprietor companies IF your state laws allow for
single owner LLC's (Wisconsin does, but not all states do). I could probably
point you toward several more generic sources of answers, but someone else may
have a concise answer from a martial arts perspective.

OK. I will give this one a try.
1. Practice the basic kicks to develop proper form.
2. Practice jumping: e.g., try plyometrics.
3. Practice the jump spin w/o the kick. Flex and extend your legs as you
spin to
simulate preparation for the proper kick-delivery positions.
Listed are a few suggestions, which may help with the spin:
a. Think light.
b. Bring your arms in towards your center line: i.e., if jumping to the
right, bring the
left arm into the center line and extend the right arm through the
center line and
into the guard position for motion control.
c. Turn your head into the jump and focus on the target.
d. Turn your shoulder into the jump and continue to focus on the target.
e. Extend the right arm to slow the rotation; see a.
f. Insert the kick once you feel comfortable with the jump spin.
g. Land lightly on the balls of the feet and with bent knees to absorb
the shock.
h. Practice left and right turn spin jump kicks.
If I left something out, more than likely you will realize it somewhere in
the middle of your jump spin. Good luck.
