In rereading this post, I realize that my use of "ignore" might be misinterpreted. I didn't mean that "I" would ignore the situation in the sense that I would fail to take appropriate steps to remedy it, but that in deciding my solution, I would ignore any idea or suggestion that I was part of the problem. I am not a martial artist but I am going to take classes soon. Now I have heard many people say "If you can avoid the fight don't fight." Now I think that if you really don't want to fight, anyone can avoid it. Eventually the other person will walk away if you keep avoiding it. Just wondering what this is all about. - ---Kadin _______________________________________________________________ Get Free Email and Do More On The Web. As screwed up as the legal system is these days, I find it >difficult to believe that a standard of dispassionate judgement would be >applied. You are right. The reasonableness of the force is viewed both subjectively and objectively. You must subjectively believe that the force is necessary and your belief must also be reasonable under all the circumstances. It is not the judgment of a dispassionate observer but of a reasonable person placed in exactly the same situation. If your belief was reasonable under the circumstances, then your use of force is justified even if a dispassionate observer might have seen another alternative. The practical problem is, however, that juries are not actually placed in the situation, but are listening to courtroom testimony as dispassionate observers. Like the "Monday morning quarterback", the jury sometimes doesn't buy the argument that "it seemed like a good idea at the time". ------------------------------ From: JBoorstein@aol.com Date: Thu, 22 Jul 1999 16:06:17 EDT Subject: the_dojang: Re: The_Dojang-Digest V6 #346 Catching up here on digests -- this reply to July 9th edition. Broken bricks can be recycled as pavers. Broken boards can certainly be used as kindling or for art projects. But I remember at one school the custom was that the first board the student broke was kept. The instructor inscribed one half of it with some saying or some such for the student, while the student did the same for the instructor. I don't know how common this is, but I've always thought it was terribly nice. However, let's be realistic. If an injury occurs and a lawsuit is filed, especially if a child is involved, you're gonna get sued personally, corporation or no. You are right about needing liability insurance. It also helps if you have a well-written liability release with the student's / parents signatures on it. If you have to go to court, it really helps to produce that form where it explains that injuries can and do occur and you understand and accept that risk. ------------------------------ From: Chuck Sears Date: Thu, 22 Jul 1999 17:13:53 -0500 Subject: the_dojang: Re: The_Dojang-Digest V6 #365 > > > From: "Aaron Harmon" > Date: Wed, 21 Jul 1999 08:43:45 -0700 > Subject: the_dojang: Re: The_Dojang-Digest V6 #363 > > > > >Finally, I am quite ignorant of laws regarding self defense. Go to the FTP site for our website, >www.martialartsresource.com, Aaah! Thank You. Very interesting video. For those who don't know (like me), when was the sine wave introduced? When I did this form in the mid-80's in Malaysia, we were not taught the sine wave. From the video, it also appears that the sine wave is executed only when the person was blocking and punching to the sides. It was not clear to me that he had the up & down motion when he was blocking while moving forward (i.e. the double knife hand block, spear-finger thrust, backfist...) Did I not see the sine wave because of the angle of the camera, or because of my poor eyesight? :-) Thanks again, Mr. Terry. I found this especially educational being a former ITF student.
