The student had earned her camo in that school. I had to bump this student (something I hardly ever do) to yellow belt, and that was being generous. The student didn't know what a round house was, etc etc...........go figure. Weissler" Date: Fri, 09 Feb 2001 17:19:18 -0800 Subject: the_dojang: Re: Contracts and Debt Collection As one of the lawyers on the list, and having created, defended and developed strategies to attack membership contracts -- let me say that the ability to challenge an instruction contract primarily depends on the contents of the contract and local state law. Three out of Five contracts I have reviewed (and I've looked at 15-20 over the past 12 years) were not enforceable. Each state has their own laws regarding the maximum time and total fee under martial arts instruction contracts. That being said there are certain rules under the the Federal Fair Credit and Collections Act which may apply for your friend. It applies to third parties seeking to collect debts. But this act only controls egregious actions. It may give some relief. If the contract has been sold to a good faith purchaser in due course - the only recourse may be to sue the school in small claim court for failure to provide what it promised to provide. If you message me off list I can ask some specific questions which may be helpful in letting me give you specific answers. As a committed martial artist I strongly support the use of contracts. It lets the uncommitted help pay for the rest of us after they drop out. While I like contracts for new students, long contract renewal terms for existing students are less comfortable to me. This is because of the undue influence of an instructor pushing a current student to renew.
