If so, do you have a contract in place between yourself and the instructor of the other activity stating that they will pay you "x" amount for doing so and so forth? I would like to get a copy of someone's contract to review it in so that I may draft up one for myselft to use. I currently sub-rent out my dojang on Tuesdays and Thursdays for gymnastics. But, I have a hard time getting them beyond green-stripe (7th gup). Some of the 5 year olds take more than 8 months just to get to yellow-stripe (9th gup). To the kids, TKD is more about having fun kicking paddles and playing the games I've made up to teach TKD skills. Some of my tykes have developed better skills then some adults of equivalent rank. They can throw combination kicks in doubles, triples, and quadruples; they can nail there stances, blocks, punches and kicks in taeguks and in drills that we do; and they can't remember their left from their right. Kids that age often surprise me at how good individual skills are when performed in one, two, or three step sequences. But give them a long sequence to 'memorize' and they get totally lost. I can't imagine a black belt at that age. I doubt all the skills taught from 10th thru 1st gup could be memorized and performed. I believe at each belt you should be able to perform all previous belt requirements at the drop of hat. Hypothetically, I could teach some of my tykes Koryo (1st Dan) and some of them would look as good as some black belts. But then, if I then taught taeguk ee jang (8th gup), most would completely forget all of Koryo within a week. I don't doubt these young black belts would have excellent kicks, stances, punches, blocks, could do one or two forms, and perform 6-10 defensive techniques (the 'new' stuff for promotion). But, being able to remember and explain all poomse, all movement drills, all 100+ defensive techniques, and everything else from 10th gup to 1st dan. Man, I would like to meet the instructor and get them to share their secret! So, that raises the question, "Are these kids really a black belt?" or "Are they just a show pieces for some club to try and impress the uninformed?" Background and Goals. A. The Problem. In assessing the USTU at the present time, we believe that the organization is very effective in developing and preparing athletes for success in international competition, and in carrying out an effective international relations program that helps to level the playing field for U.S. athletes. At the same time, USTU recognizes that, during the 18 month period consisting of the year 2002 and the first half of 2003, serious financial and accounting problems existed. USTU has not fully recovered from these problems, and they have cast doubt on both the financial capability of USTU to serve as the NGB and its managerial capability. Further, USTU recognizes that there are several items in its governance structure that must be revisited and addressed as soon as possible, including (a) the size of the Board of Governors; (b) far too many appointments by the President, including at the Board level and for state presidents; and (c) a club-based system of governance that provides an incentive to become a member of USTU, but at the same time has provided some with an incentive to inappropriately register individuals to increase their political power. B. Why A Resolution Is Important. A resolution of this matter, as opposed to a de-certification process, is in the best interests of USTU, the USOC and the athletes. (1) The Athletes. With less than 11 months until the Athens Olympics, we need to give our athletes every chance to succeed. The USTU has been very effective in delivering benefits to the athletes. De-certification of the USTU would create much confusion and uncertainty for the athletes, all at a time when we want them to focus on training, qualifying for the Games and succeeding at the Games. (2) The USOC. De-certification of USTU would create significant hassles for the USOC on two fronts. First, taking over the sport of taekwondo would be complicated. While the USOC could no doubt select the athletes for the Games, the USOC would also have to address, almost immediately, such issues as how to qualify for the maximum number of spots in the Games, training, overseeing the several levels of qualification, delivering benefits to athletes, handling international relations, etc. We believe the USTU is better suited to deal with these taekwondo-related issues. Second, the de-certification process would be a long, drawn-out process that would require the USOC to spend time and money, all at a time when the USOC needs to focus on Athens. (3) The USTU. The benefits to USTU are obvious. USTU wants to maintain its NGB status, and at the same time, it must address the issues raised by the Membership and Credentials Committee. USTU devotes a lot of time and energy in dealing with these issues, and relieving it of these burdens by fixing the problems would be a huge step forward. At the same time, resolving this matter would allow USTU to focus on its athletes and their success in the Games. C. The Goals. In developing a remedial program for USTU, we believe that the following elements are critical: (i) stabilize USTU's financial and managerial capability, (ii) provide a mechanism for the USOC to monitor and oversee the progress of USTU in achieving these goals, and at the same time giving the USOC an opportunity to provide assistance to the USTU in areas of expertise; and (iii) create a committee comprised of diverse and qualified individuals to develop and implement a fair and representative governance system for USTU. All the while, USTU aims to protect USTU's elite athlete program and the ability of USTU to select and prepare a team appropriate for success in Athens. In creating this proposal, USTU has looked extensively to USA Boxing as a model. By using some of the elements that have worked effectively for Boxing, and modifying them to fit USTU's unique situation, we believe we have developed a remedial system that will achieve these goals. Therefore, USTU proposes the following: 2. Remediation Plan. A. Executive Director. On or prior to October 1, 2003, USTU will accept, receive and hire a USOC employee, who will be on loan to the corporation, to serve as the Executive Director of USTU. The person serving as the new Executive Director will be hired at the sole discretion of the USOC, after consultation with the USTU. This person shall have operational control of the USTU, shall be responsible for implementing the mission and policies of the USTU, shall oversee, manage and have full authority to execute all day-to-day business and operations of the organization, and shall perform such other functions as usually pertain to that office. This includes managing the staff and operations by making all personnel, financial and management decisions. The Executive Director shall report to the Governance and Management Committee (as described in Section C below) and shall keep the Executive Committee and Board of Governors informed of his activities as appropriate. The salary for this position shall be paid by USTU, with the benefits being paid by the USOC. The term of this Executive Director will end once the USOC has determined that USTU has adopted both a governance and management structure that will allow USTU to carry out effectively and fairly its duties and obligations as an NGB, with the possibility that USTU may want the Executive Director to remain beyond this term. B. Chief Financial Officer. On or prior to October 15, 2003, the USTU will hire a competent financial manager or outside contractor to serve as Chief Financial Officer. In the hiring process, USTU will seek recommendations and assistance from both the USOC and USTU's independent auditors, Waugh & Associates, P.C. The person hired to this position within USTU will report directly to the new Executive Director of USTU. C. Governance and Management Committee. On or prior to October 1, 2003, the USTU will establish a Governance and Management Committee comprised of five (5) persons. The expenses of the Governance and Management Committee shall be paid by USTU. The Governance and Management Committee will be charged with the following duties: (1) Analyzing, studying, proposing and ensuring that USTU alters its governance structure to (i) ensure that the participation in the governance of USTU is effectively open to all interested parties; (ii) ensure that the election processes utilized to determine those persons in governance positions is fair, (iii) ensure that the governance structure of USTU fairly reflects all interests in the sport of taekwondo; (iv) reduce the size of the Board of Governors to a more manageable and effective level; (v) eliminate or greatly reduce the authority of the President to appoint individuals to positions within the governance structure; and (vi) establish a means for selection of state presidents in small-membership states that does not involve appointment by the President; (2) Monitoring USTU to ensure that it properly complies with the USOC directives and mandates; (3) Overseeing and assisting the Executive Director in his/her managerial capacity, ensuring that the Executive Director can carry out his/her financial and managerial responsibilities without unwarranted interference, and liaising with the Executive Committee and the Board of Directors regarding the Executive Director's activities: and (4) Updating the USTU Board of Directors on the progress of achieving the goals as stated in Paragraph 1C above. The Governance and Management Committee shall be composed of the following individuals: (A) One (1) Athlete Representative who meets the USOC definition; (B) One (1) member of the USTU who is reasonably satisfied with the current USTU; (C) One (1) member of the USTU who is not currently satisfied with the current USTU; (D) One (1) person from the USOC; and (E) One (1) person with experience in the governance of other National Governing Bodies. The USTU shall recommend capable persons who are willing to serve on the Governance and Management Committee to fill the positions described in categories (A), (B) and (C), and the USOC shall recommend capable persons who are willing to serve on the Governance and Management Committee to fill the positions described in categories (D) and (E). The USOC shall have the authority to finally select all five (5) members of this committee and to designate the chair of this committee, which shall be recognized by the USTU. The Management and Governance Committee will remain in place for a sufficient period of time to ensure the proper governance of USTU to the satisfaction of the USOC and at least until USTU implements the new governance structure (which shall be on or before the USTU annual meeting scheduled for November 2004). D. USTU Budget and Audit Committee and Finance Committee. The USTU will seek immediate resignation from the five (5) members of its Budget and Audit Committee and six (6) of the seven (7) members of its Finance Committee. These committee members will be replaced by individuals identified by the USTU Executive Committee who are acceptable to the USOC, with the exception of the one (1) Athlete Representative to the Audit and Budget Committee and the two (2) Athlete Representatives to the Finance Committee, who shall be selected by the USTU AAC.
