MTA, represented by counsel Datuk M.S. Murthi, have asked the court to rule on the validity of the de-registration and to determine the scope and the extension of the Sports Commissioner's powers under the Sports Development Act 1997. "We will serve the summons on the relevant parties once they are extracted from the High Court. "We cannot discuss the issue further because it will be subjudice," said Murthi late last night. MTA were de-registered last Friday, making them the first national high-performance sports body to be struck off since the Sports Development Act came into force in January 1998. Elyas' decision to de-register the beleaguered association was based on MTA's so-called failure to comply to his directives to grant automatic membership and voting rights to clubs. MTA have 30 days, from the date of the notification, to appeal to the Sports Minister. The former Mayor of Kuala Lumpur issued a showcause letter on April 15, threatening to suspend or de-register MTA after having formed the opinion that the proposed articles 5.8 and 6.4 in their constitutional amendments relating to the definition of a club and membership of clubs as complicating rather than simplifying the process. Following the showcause letter, MTA had on April 25 filed a writ of summons, mounting a constitutional challenge on the legal validity of certain sections of the Sports Development Act on the grounds they violate the Federal Constitution. Could it possibly be that the GTFs GM Datuk Sabree is too influential to be a first target, or that Sports Minister Datuk Azalina Othman Said is an ITF 5th Dan? Not to mention Datuk Hishammuddin Hussein (Datuk Azalina's predecessor) who is a member of the WTF. Life in Malaysia can certainly be complicated, with political friendships and expediency often going hand in hand with financial leverage, and the MA are no exception. I personally wonder if the pond was simply not big enough for four fish, and so a deal was struck to remove one.
