Besides, the guys' technique looked good and effective (judging from the impact on the striking pads). Why do you think the video is BS, or is it the particular school of TKD that is BS? Check it out. --__--__-- Message: 3 From: "Don Ross" To: "dojang_digest" Date: Sat, 20 Jan 2007 10:16:42 -0500 Subject: [The_Dojang] gun disarms/downrange liability Reply-To: the_dojang@martialartsresource.net My admittedly limited understanding of the liability issue is that in ANY self-defense incident where the aggressor/felon-in-action is injured/killed, there will almost automatically be a civil lawsuit filed against the victim/defender, even if there are no criminal charges filed against the victim/defender. Then the burden of proof changes from 'beyond a reasonable doubt' [criminal court] to 'a preponderance of the evidence' [civil court]. This is another of the self-defense realities they don't show in movies/TV. However re bystander injury/death, I believe that in some States there is a legal principle [can't recall the name though] that during the commission of a felony, the initial perp is criminally responsible for any death/injury resulting. Thus a robbery victim's death by heart attack becomes a murder charge for the robber even if the robber never touched him. But then there is still that pesky civil liability thing. Any Attorneys on the List please clarify/correct.
