I have trained lawyers and have often discussed self defense with them. But I'm not a lawyer. The fact is many men make this wild leap of logic that it's not hitting if I don't make a closed fist. Or it's shows that I didn't want to REALLY hurt them if I didn't make a fist. You see this in domestic violence complaints all the time. "I didn't hit her I just slapped her." It's all just rubbish. Hitting is hitting and the Law knows that. Remembering that laws are different in all states, open or closed hands makes no difference in wither you hit the person or not. In addition you are making the assumption that no one in the court, the lawyers or the weasel have ever heard of or taken martial arts before. I would bet one of them has at least heard of a "karate chop" if not spent time in at least a McDojo and got their black belt when they were 7. And since they will all know of your martial arts training the less informed of them will wonder why you don't have your hands and feet registered, while the informed will see that you used calculated open hand strikes that are every bit as dangerous and now you are trying to hide what your intent was by acting as if an open hand is less than lethal. And don't be surprised if they call your martial arts instructor up as a witness to show you know the difference. Basic lawyer logic: Argument 1: Your statement "I wasn't trying not to hurt him" = I was in control and not afraid = I didn't think he could hurt me = I shouldn't need to hit him at all. Argument 2: Your statement "I thought he was trying to kill me so I hit him with everything I had." = You were afraid for your life and were trying to defend yourself. Again I'm not a lawyer, I don't play one on TV and I'm not a congressman who plays a lawyer but wants to be president. But one of the things that we make note of in our womens self defense classes is this concept men have about "if I really wanted to hurt whoever I would have made a fist". which is what brought me out of years of lurker mode to make this post. Thankfully the courts have made a little progress out of the stone age and see that open hand or closed, hitting is hitting. So you better think of a different basis for your defense.
