U.S. District Judge Gray H. Miller signed an order Friday dismissing the case on the grounds the court has no jurisdiction in the matter. Abdallah claimed she was judged unfairly in two matches against Diana Lopez of Sugar Land, last month at the Olympic trials in Colorado Springs, Colo. She asked that she be declared the winner of the second match and that a third match be ordered to determine the U.S. Olympic team member in the bantamweight/featherweight division. But attorneys for the U.S. Olympic Committee argued that overturning a field of play decision was not within the court's jurisdiction and that Abdallah should be required to abide by the USOC appeals process, which requires disputes to be submitted to arbitration. "We hoped it wouldn't be that way, but we will try to go to arbitration and see where it goes from there," Abdallah said Saturday. David Askinas, CEO of USA Taekwondo, said USOC officials expected the judge to dismiss the case quickly. Diana Lopez and her brothers, Steven and Mark Lopez, will compete this week in Manchester, England, at the World Taekwondo Union's world Olympic qualifier. If they finish in the top three, they will qualify for the 2008 Olympic Games in Beijing. --__--__-- Message: 2 Date: Sun, 16 Sep 2007 15:29:49 -0400 From: "Charles Richards" To: the_dojang@martialartsresource.net Subject: [The_Dojang] WTF USOC and legal system Reply-To: the_dojang@martialartsresource.net i read "Perhaps she should have just knocked out Lopez....that way its an instant win. Leaving the decision in the judges hands is always subjective. It is sad that she is trying to have the legal system determine if she was kicking accurately." mc reply, One of mentors once shut me up about WTF judges not scoring body punches. His reply was "If you knock them out with a body punch...." I have some good friends that refuse to do poomse in tournaments because there is too much judges influence.... A win by knockout, or the other party's withdrawing is uncontestable :-) I'd rather spend my time at Ken's looking at the vintage cars and figuring out what flavor slurpee I want than worrying about a handful of human beings (judges) opinions...
